The petitioner seeks regular bail in connection with Special Case no.18 of 2016 arising out of Sikti (Bardaha) P.S.Case no.74 of 2016 dated 9.5.2016, registered for offences punishable under Sections 20, 22, 23, 24 of N.D.P.S. Act.

Allegation against the petitioner is about recovery of 20 kg. of ganja from the house.

Submission of the learned counsel for the petitioner is that there is no material available on the record to show that the same was recovered from the room of the petitioner rather from the house, as such the petitioner is not responsible for that. He is in custody since 10.6.2016.

Heard learned A.P.P. also.

No.54352 of 2017 (2) dt.17-11-2017 2/2 Having heard both sides and in view of facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conduct it as soon as possible. At the same time, the S.P., Araria is directed to see that the witnesses are produced in the court so that the trial may be concluded as soon as possible.

With the aforesaid observation, this application is dismissed.
