ANJANA MISHRA ORAL ORDER 02-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.01.2018 in connection with Bihta P.S. Case No.38 of 2018 registered for the offence under Sections 399 and 402 of the Indian Penal Code and Section 25(1-B)a, 26/35 of the Arms Act. Learned counsel for the petitioner submits that there was recovery from the Bolero vehicle and not from the conscious possession of the petitioner. It is further submitted that similarly situated co-accused has since been extended the privilege of bail in Cr. Misc. No.42583 of 2018, vide order dated 19.07.2018.

Considering the aforementioned facts and

Patna High Court Cr.Misc. No.44256 of 2018 (2) dt.02-08-2018 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Danapur, District Patna, in connection with Bihta P.S. Case No.38 of 2018.
