For the Opposite Party/s : Mr. Lalan Kumar (App) ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 10-03-2015 The petitioner is alleged to have committed the offence punishable under Sections-302, 307 and 34 of I.P.C. which is the subject-matter Phulwari Sharif P.S. Case No.412 of 2002, corresponding to S.T. No.1130 of 2011. Prayer for bail in S.T. No.1130 of 2011 before learned Addl. Sessions Judge-IV, Patna, was rejected through order dated 12.9.2011. Hence, this application for grant of bail under Sections-439 and 440 of Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.
The allegation against the petitioner is, no doubt, serious. The fact, however, remains that the petitioner has been arrested way back on 6.5.2011 and he is in jail custody for the past about four years. Not only the investigation is complete, but the trial is also in
Patna High Court Cr.Misc. No.49463 of 2012 (6) dt.10-03-2015 2/2 progress. Detention of the petitioner is no more necessary in the trial. As such, the application is allowed.
The petitioner is directed to be released on bail upon furnishing the bail-bonds of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge-IV, Patna in connection with S.T. No.1130 of 2011 arising out of Phulwari Sharif P.S. Case No.412 of 2002.
