2. The petitioner apprehend his arrest in connection with Madanpur P.S. Case No. 100 of 2020 instituted under Sections 419, 420 and 409 of the Indian Penal Code.
3. As per the prosecution case, a sum of Rs. 907500/- had been given to the petitioner for supplying the material required for completion of various Government schemes in Ward No. 12 of Ghora Dehari Gram Panchayat but the same has not been done.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He has already supplied the required material regarding Nal Jal scheme within time worth Rs. 12,10,750 and as such the
Patna High Court CR. MISC. No.21970 of 2024(2) dt.22-04-2024 2/2 work has been completed and dues amount of the petitioner has not been paid. In this regard, he has referred the copy of measurement book. He further submits that the petitioner has no criminal antecedent and he undertakes to co-operate in the investigation.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 100 of 2020, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Sunil Dutta Mishra, J) ashishkr/- U T
