1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Sessions Trial No. 1480 of 2022 arising out of Bakhtiyarpur P.S. Case No. 298 of 2021 dated 23.12.2021 registered for the offences punishable under Sections 387, 307 of the Indian Penal Code and Section 27 of the Arms Act.

3. The main submissions advanced by the learned counsel for the petitioner are that the informant has compromised this case with this petitioner, in fact petitioner had purchased sand from the informant by paying Rs. 12,400/- but the less quantity of sand was delivered by the informant which was the genesis of the alleged occurrence and moreover the petitioner has been languishing in jail since 05.07.2022 in the

Patna High Court CR. MISC. No.20051 of 2023(2) dt.10-05-2023 2/2 present matter and against him the investigation has been completed.

4. Learned APP appearing for the State opposes the bail prayer.

5. Considering the above submissions and mainly the completion of investigation against the petitioner and his custody period and also the facts that in the alleged firing committed by this petitioner, no one sustained any injury and as per the statement made in paragraph no. 8 of the petition there was dispute in between the petitioner and informant regarding the purchase of sand and also taking into account the petitioner's young age, in the opinion of this court, the petitioner deserves to a lenient approach of this court. Accordingly, let the petitioner be released on bail in connection with Sessions Trial No. 1480 of 2022 arising out of Bakhtiyarpur P.S. Case No. 298 of 2021 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
