JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,447,341,323,307 and 379 of the Indian Penal Code. The prosecution case is that the petitioner and co accused Shyamdeo Yadav entered into the house of the informant and asked the informant to compromise the earlier case. On protest being made, the petitioner along with co accused Shyamdeo Yadav assaulted with iron khanti to the informant and his son Sudhir yadav. When Raj Kumari Devi and Reshmi Devi came to rescue, they were also assaulted. Co accused Sonu Kumar and Raju Kumar snatched gold ear ring from the wife and daughter in law of the informant.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.22896 of 2016 (2) dt.23-05-2016 2/2 that in the background of bonafide land dispute the accusation has been levelled. Though the informant has received one grievous injury but there is counter version of the occurrence also where the petitioner side also received injury.

Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Parasbigha P.S. Case No. 21 of 2016 pending in the court of learned J.M. Ist Class, Jehanabad.

This application is disposed of with the aforesaid observation/direction.
