2. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 363 , 366A and 34 of the Indian Penal Code and section 8 of POCSO Act.

3 . It is alleged that this petitioner along with other co-accused persons kidnapped the minor daughter of the informant for the purpose of marriage .

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, he is simple victim of false allegation. The victim in her statement recorded under section 164 Cr. P . C has not stated anything wrong against this petitioner. Chargesheet has already been submitted. He is in custody since

5 Learned counsel for the informant vehemently opposed the bail petition .

6. Considering the statement of the victim under section 164 Cr. P . C and other circumstances of the case, prayer for bail of the petitioner is allowed.

7. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge - cum- Special Judge , POCSO Act, East Champaran , Motihari, Bihar in connection with Town Police Station Case No. 517 of 2023 .
