Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated Spl. (N.D.P.S.) Case No.04 of 2016 passed in Cr. Misc. No.20(b) of the N.D.P.S. Act, 1985 and there is recovery of 92 kg. ganja.
Submission of the learned counsel for the petitioner is that nothing has been recovered from her possession and she was co-passenger and another co-accused has been granted privilege of the bail vide order dated 28.3.2018 passed in Cr. Misc. No.10374 of 2018.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.46433 of 2018 (2) dt.02-08-2018 2/2 circumstances as well as the fact that she is a lady and remained in custody for more than 1 1⁄2 years, as such, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Addl. Sessions Judge, Nawada in connection with Spl. (NDPS) Case No.4/2016, with condition that she has to appear before the court below as and when required by the court concerned, otherwise her bail bond shall be cancelled. With the aforesaid observation, this application is allowed.
