Petitioner, already in custody, seeks bail in connection with Barachatti P.S. Case No.171 of 2017, registered under Sections 302/34 of the Indian Penal Code.

Allegation in brief is that one Pramod Paswan came to the house of the informant, asked the deceased to bring chicken and prepare it and after cooking chicken the informant's husband went along with Pramod Paswan and thereafter next day dead body of the husband of the informant was found in a well situated behind the house of the petitioner.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner, only suspicion is raised as the dead body of the informant's husband was found in a

Patna High Court Cr.Misc. No.60941 of 2017 (2) dt.19-12-2017 2 /2 well nearby the house of the petitioner, however the cause of death is drowning, this petitioner has no criminal antecedent and he is in custody since 05.06.2017.

Having considered the said facts and circumstances, let petitioner, Bagad Manjhi @ Bangar Manjhi, be directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, Gaya in connection with Barachatty P.S. Case No.171 of 2017.
