This application for grant of anticipatory bail arises out of Jhanjharpur P.S. Case No. 148 of 2015, disclosing offences under Sections 304(B), 201/34 of the Indian Penal Code. Petitioner no. 1 is the father-in-law and petitioner no. 4 is mother-in-law of the deceased. The petitioner nos. 2 and 3 are brothers and petitioner no.5 is sister of the husband of the deceased.

Learned counsel appearing on behalf of the

Patna High Court Cr.Misc. No.24038 of 2016 (3) dt.14-07-2016 2/2 petitioners has submitted that the allegation of demand of dowry and torture therefor are general and omnibus in nature. There is no specific allegation of demand of dowry against anyone of these petitioners.

Considering the above, this application is allowed. Let the petitioners, above-named, in the event of his arrest/surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jhanjharpur, in Jhanjharpur P.S. Case No. 148 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioners shall present themselves before the police/court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutives occasions, their bail bonds shall be liable to be cancelled.
