The petitioner seeks bail in Majhaulia P.S. Case No.404 of 2019 registered under Sections 399, 402, 414 of the Indian Penal Code and under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The informant alleged that while he was on patrolling duty, he saw 3-4 motorcycles with unknown miscreants in suspicious condition but seeing the police, they started fleeing away. On chase, Sonu Choudhary and Purushottam Dubey were apprehended. Other accused persons including the petitioner are alleged to have fled away.

The learned counsel for the petitioner submits that petitioner was not apprehended on the spot. Nothing has been recovered from the possession of the petitioner. Petitioner is in

Patna High Court CR. MISC. No.16292 of 2020(2) dt.02-06-2020 2/2 jail since 04.12.2019.

Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that nothing has been recovered from the possession of the petitioner and petitioner is in jail since 04.12.2019, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S. Case No.404 of 2019.
