JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is apprehending her arrest in a case registered under Sections 406,420,120(B),504 and 34 I.P.C. and subsequently Sections 467,468 and 471 I.P.C. have been added. The prosecution case, in short, is that the accused persons cheated the informant on the ground of giving employment to him in the Collectorate, Purnea as Assistant and received Rs. 6,00,000/-. It is alleged that out of the said amount, the informant paid some money in the Bank Account in favour of accused, Kumar Gaurabh and his wife, Kumari Priyanka and some money was given in cash.
Patna High Court Cr.Misc. No.28648 of 2015 (3) dt.01-10-2015 It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case due to mistake of facts. The petitioner is a lady and she is ready to deposit an amount of Rs.45,000/- in the court below, which shall be released in favour of the informant.
On behalf of the State, it is stated that the petitioner is named in the first in formation report.
Considering the facts aforesaid, the petitioner is directed to deposit an amount of Rs.45,000/- in the court below within a period of four weeks from today, which shall be released in favour of the informant.
Let the petitioner, above named, in the event of her arrest/surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with K.
