====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 26-09-2022 Heard learned Senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleges that the accused persons, including the petitioner, came variously armed at his door and started assaulting his son, it is next alleged that Birendra Prasad Singh assaulted by a sharp-edged Gupti in abdomen of his son whereas co-accused Chandradev Singh is alleged to have fired on him but missed, thereafter it is alleged that the other accused persons including the petitioner also assaulted his son who

Patna High Court CR. MISC. No.19017 of 2022(2) dt.26-09-2022 2/3 succumbed to his injuries subsequently during the course of treatment.

Learned Senior counsel for the petitioner submits that the petitioner is a person with clean antecedent, there is general and omnibus allegation of assault against the petitioner and the specific accusation of assault is against Birendra Prasad Singh and on account of previous dispute, the petitioner has been made accused in the present case. Learned senior counsel next submits that similarly situated co-accused Saroj Kumar Singh has been granted anticipatory bail by order dated 23.02.2022 in Criminal Miscellaneous No. 23484 of 2021.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bidupur P.S. Case No. 418 of 2020 subject to the conditions as laid down under
