The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on a raid being conducted, it is stated that while the petitioner managed to escape, certain utensils for manufacture of Mahua liquor as also 15 litres of country liquor was recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from petitioner's possession or his house. He has been falsely implicated in the case because of his antecedent. He is in custody since 24.1.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having been arrested at the spot together with the petitioner having remained in custody for over 10 months, the Court directs the petitioner to be enlarged on bail in connection with Tekari (Panchanpur O.P.) P.S. Case no.605 of 2020 (CIS no.1709 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cumSpecial Judge, Excise Act, Gaya.
