This application for anticipatory bail arises out of Koilwar P.S. Case No. 09 of 2021 for the offence punishable under Sections 384, 386, 307, 427/34 of the Indian Penal Code and under Section 25(1-b)a, 26, 35 and 27 of the Arms Act. Learned counsel for the petitioners seeks permission to withdraw this bail application on behalf of petitioner no.1, who has been arrested by the Police. Accordingly, this bail application is dismissed as

Patna High Court CR. MISC. No.27622 of 2021(2) dt.16-12-2021 2/2 withdrawn as against petitioner no.1, above named. In view of the fact that petitioner no.2 was the representative of the company which was given the contract for sand mining, this application is also allowed. Let the petitioner no.2, above named, in the event of his his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Koilwar P.S. Case No. 09 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
