JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 307 and other allied Sections of the Indian Penal Code.
The FIR was lodged on the basis of fardbeyan of one Yasim Khanam on 22.5.2015. The accusation against the petitioners is of assaulting the informant and her other family members and relations causing not only injuries on the vital parts of their bodies but also their acts or omission facilitated the another accused to make their attempt to outrage her modesty. It has been submitted on behalf of the petitioners that no specific allegation has been made against the petitioners.
Patna High Court Cr.Misc. No.27334 of 2015 (2) dt.21-07-2015 2/2 Further it is submitted that petitioner no.1 is aged 70 years. It is also submitted that the petitioners have falsely been implicated in this case.
On behalf of the State, it has been submitted that there is allegation of assault against the petitioners. Further the injuries caused upon the informant are grievous in nature Considering the aforesaid facts, I am not inclined to grant anticipatory bail to petitioner nos. 2 and 3 and the same is rejected.
So far petitioner no.1 is concerned, considering the age of petitioner no.1, in the event of his arrest/ surrender in the court below within a period of four weeks, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Miss. Akanksha Kashyap, learned Judicial Magistrate, 1st Class, Gaya, in connection with Khizarsarai P.S.Case No. 97 of 2015,subject to the conditions as laid down u/s 438(2) Cr.P.C.
