JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 461/379 of the IPC.

Petitioner is not named in the first information report but from perusal of the impugned order, I find that stolen mobile is said to have been recovered from the conscious possession of the petitioner.

Submission on behalf of the petitioner is that present case was lodged after ten days of the occurrence and so-called recovery is said to have made after one month of the alleged occurrence. It is also submitted that petitioner does not have any criminal antecedent and is languishing in

Patna High Court Cr.Misc. No.43681 of 2018 (2) dt.23-07-2018 jail custody since 13.4.2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in Kotwali (Basudeopur) P.S. Case no. 87/2018.
