Patna High Court C.Misc. No.286 of 2016 (2) dt.16-08-2016

IN THE HIGH COURT OF JUDICATURE AT PATNA

CIVIL MISCELLANEOUS JURISDICTION No.286 of 2016 ====================================================== Murli Paswan .... .... Appellant/s

Versus

Ragini Devi .... .... Respondent/s ====================================================== Appearance :

For the Appellant/s : Mr. Dilip Kumar Roy For the Respondent/s : Mr.

====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 16-08-2016 Heard the learned counsel, Mr. Manoj Kumar Singh, for the petitioner.

Perused the order dated 18.12.2015.

The learned Court below by the impugned order has directed the petitioner to pay monthly maintenance of Rs.3000/- per month recoding a finding that the petitioner is working in a factory in Rajasthan. This order has been passed pursuant to the direction given by the High Court in an application for anticipatory bail.

In view of the above facts and circumstances of the case, the High Court in exercise of jurisdiction under Article 227 of the Constitution of India cannot hold the Pancayati and fix the rate of monthly maintenance which is to be awarded to the wife by the husband in a matrimonial case. Therefore, I find no reason to interfere with the impugned order. Thus, this Civil Misc. application is dismissed. (Mungeshwar Sahoo, J) Sanjeev/- U
