Petitioners apprehend their arrest in a case registered for the offence punishable under Section 272, 273 of the Indian Penal Code and under Section 30 (a) of the Bihar Prohibition & Excise Act.

As per the prosecution case, 110 liters of country made liquor has been recovered from the hut of the petitioners. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioners and they are no way

Patna High Court CR. MISC. No.18556 of 2022(2) dt.22-07-2022 2/2 concerned with the alleged recovery. Petitioners have got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that 110 liter of country liquor has been recovered from the hut of these petitioners. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
