JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioners are apprehending their arrest in connection with Hasanpur P.S. Case No. 56 of 2015 for the offences instituted under Sections 448, 341, 323, 324, 308, 354, 379, 384, 504, 506/34 of the Indian Penal Code. Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that the accused persons demanded Rangdari and when the victims opposed the same, they gave Farsa, Lathi and Bhala blow on them and also stanched away Gold chain and Gold Top of the victims. It has been submitted on behalf of the petitioners that there is a case and counter case between the parties, due to

Patna High Court Cr.Misc. No.27946 of 2015 (2) dt.22-07-2015 2/2 Complaint Case No. 172 of 2015 the petitioners have been falsely implicated in the present case. There is land dispute between the parties. It is further submitted that both the parties are agnates and petitioners have got no criminal antecedent.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Hasanpur P.S. Case No. 56 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st class, Rosera, Samastipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
