The petitioner seeks bail in connection with Kopa P.S. Case No. 11 of 2019 instituted for the offence under Section(s) 302/34 of the Indian Penal Code.
It is alleged in the written report that informant got information that few boys are assaulting his son, namely, Junaid Khan at Kopa High School. The informant went to the place of occurrence and saw that Kishan Sharma and Azad Sharma were assaulting his son with knife on the neck. There were 2-3 unknown boys also present there.
Learned counsel for petitioner has submitted that
Patna High Court CR. MISC. No.16836 of 2019(2) dt.26-03-2019 2/2 petitioner is not named in the written report. The name of this petitioner has come during investigation in para 72 and 73 of the case diary levelling allegation that he was instigating his son. Similar fact finds mentioned in the impugned order passed by the learned Sessions Judge.
Petitioner is in custody since 29.01.2019 having no criminal antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Chapra at Siwan in connection with Kopa P.S. Case No. 11 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/mu keshU T
