JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner is apprehending his arrest in Tr. No.1932/14 arising out of Complaint Case No.2632/12 for the offence under Section 498(A) of I.P.C. , Sections 3 and 4 of the D.P.Act.
Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that marriage of the complainant was solemnized with the petitioner on 16.6.2009 but after some time in-laws of the complainant started dowry demand and on non-fulfillment of the same she was subjected to torture and ultimately ousted from her matrimonial home.
Patna High Court Cr.Misc. No.28905 of 2015 (2) dt.24-07-2015 2/2 On behalf of the petitioner it has been submitted that petitioner is ready to keep the complainant with full dignity and honour.
Learned counsel for the complainant submits that she is also ready to stay with the petitioner. On behalf of the State it has been submitted that both the parties are ready to live with each other. Taking into account the fact that the matter has been settled between both the parties, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Saran at Chapra, in Tr.No.1932/14 arising out of Complaint Case No.2632/12 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
