JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 399 and 402 of the IPC.

Petitioner and others assembled to make preparation for committing dacoity but they were caught and it is claimed that one country made katta and one live and one empty cartridge were recovered from conscious possession of the petitioner.

Learned counsel appearing for the petitioner submits that for the same occurrence, three separate cases were lodged and the petitioner has already been granted

Patna High Court Cr.Misc. No.43697 of 2018 (2) dt.23-07-2018 privilege of bail in two cases which had been lodged for the offence punishable under the Arms Act as well as for the offence punishable under Excise Act.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl.
