JUSTICE SUDHIR SINGH ORAL ORDER 24-09-2015 Heard learned counsels for the petitioner, informant and learned counsel for the State The petitioner is apprehending his arrest in connection with Bhabua (Sonhan) P.S. Case No. 241 of 2015 for the offences instituted under Sections 376/511, 147, 323, 452, 380, 504, 506, 379/34 of the IPC and 27 of the Arms Act.
The prosecution story, in brief, is that in the field, the informant was attending the call of nature, Sudarshan Ram came there, pinned down the informant and attempted to commit rape, on alarm her son turned up and then he escaped away then her husband went to the house of the accused to complain about the incident then they all assaulted him and her son. It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.27410 of 2015 (3) dt.24-09-2015 2/2 petitioner has got no criminal antecedent. It is further submitted that the alleged date of occurrence is 07.02.2015 and complaint was filed on 13.02.2015 which was referred for institution of the F.I.R. under Section 156(3) of Cr. P.C. There is no explanation for delay in filing the case. It is further submitted that the petitioner and the informant are close agnates and there is an admitted land dispute between the parties.
On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Bhabua (Sonhan) P.S. Case No. 241/2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhabua (Kaimur), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
