JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,323,324,325,427,436,379,504 and 506 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the accused persons including the petitioner came and started assaulting the informant when wife of the informant came, she was also assaulted by co accused Naresh Prasad and this petitioner.

It is submitted by learned counsel for the petitioner that in the background of 144 Cr.P.C. proceeding and title suit being pending, the accusation has been levelled when the land is claimed

Patna High Court Cr.Misc. No.35792 of 2014 (3) dt.02-04-2015 2/2 to have been purchased by the informant from the brother of the petitioner who has transferred the share of the petitioner also. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with SC/ST P.S. Gaya Case No. 109 of 2013 pending in the court of learned CJM, Gaya.

This application is disposed of with the aforesaid observation/direction.
