ANJANA MISHRA ORAL ORDER 27-08-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody since 02.05.2018 in connection with Sasaram (Agrer) P.S. Case No. 612 of 2018 for the offence registered under Sections 366(A), 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though it has been stated in the first information report that the petitioner had kidnapped the victim girl, namely, Maya Kumari, aged about 17 years, the victim girl in her statement under Section 164 Cr.P.C. has stated that her age is 19 years and has also stated that she had not been kidnapped and she was having a love affair with the petitioner and they had together eloped and got married at Ludhiana. It is further submitted that the petitioner is willing to co-operate in any further investigation and also in the trial which may ensue.

No.46200 of 2018 (2) dt.27-08-2018 Considering the statement of the victim girl under Section 164 Cr.P.C. and the statement of the petitioner that he shall cooperate in any further investigation and also because the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas in connection with Sasaram (Agrer) P.S.
