2. In view of the stand taken by the State-respondents in paragraph nos. 8, 9 & 13 of the counter affidavit which is reproduced hereinbelow;

8. That the land in question i.e. Khata No.

1299, Kheshra No. 6106 in Mauza-Bathnaha, Thana No. 183 has not been acquired under the aforesaid project, Thus payment of compensation for the said land does not arise.

9. That the petitioner submitted claim for payment of compensation for the land in question which has not been acquired and hence the claim of the petitioner for payment

Patna High Court CWJC No.4961 of 2020(7) dt.23-09-2024 2/2 of compensation is not acceptable.

13. That the statement made in para 7 & 8 is concerned, it is submitted that the land in question has not been acquired under the said project and criteria for compensation and award has been followed as per the guidelines provided in Bihar Land Acquisition, Resettlement and Rehabilitation Policy, 2007.

3. No case is made out for the interference of this Court, accordingly, the same is hereby dismissed. (Rajesh Kumar Verma, J) ajay/- U
