However, learned counsel of the petitioner submits that alias name of petitioner has been left to be typed in petition. He further submits that due to unavoidable circumstances, defect as pointed out by the office could not be removed. However, he submits that alias name of petitioner be read as Mithu Singh. He assures that he shall remove the defect when the court starts normal function.
Heard learned counsel appearing for the petitioner,
Patna High Court CR. MISC. No.20595 of 2020(2) dt.04-11-2020 2/3 namely, Parasnath Singh @ Mithu Singh as well as learned Additional Public Prosecutor for the State through video conference.
Petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 309 of 2017 registered for the offences punishable under Sections 341, 323, 379, 504, 506, 308/34 of the Indian Penal Code.
Perusal of first information report goes to show that dispute between the parties took place on account of flow of drainage and furthermore, FIR reflects that petitioner and informant are neighbours. The impugned order goes to show that injureds have sustained simple injury.
No doubt, petitioner is said to have assaulted the informant by means of lathi and also snatched his belongings but considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in Muffasil P.S. Case No. 309
