In this application for anticipatory bail the petitioner apprehends her arrest for the offence punishable under sections 406, 420, 467, 468 and 471 of the I.P.C.
Allegedly, the petitioner was found running Krishna Nurshing Home with Dr. Krishna Kumar, a fake doctor and they indulged in operation of the patient and taking huge amount from them.
Submission is that the petitioner is a poor lady and she has been named in the Nurshing Home as Joint Director. In fact the petitioner is a trained A.N.M. and gives nurshing services to the patient in her house as per prescription of the doctor. She has never worked in the alleged Krishna Nurshing Home. The enquiry report is merely a table report. There is no material against the

No.37300 of 2014 (2) dt.29-01-2015 2/2 petitioner which connects her with the alleged occurrence and moreover the petitioner is a lady and as such deserves sympathetic consideration, to which the learned A.P.P. opposes. In the facts and circumstances as stated above, considering gender of the petitioner, in case of her arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Darbhanga in Beheri P.S. Case No. 355 of 2013, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
