The petitioners are in custody since 26.07.2017 in connection with Pothia P.S. Case No. 140 of 2017 for the offence registered under Sections 414, 379 and 411 of the Indian Penal Code.

The allegation is that some persons were going on a Pick-up van with 25 quintals of stolen electric wire and the same was recovered and persons who were on the pick-up van were taken into custody.

Learned counsel for the petitioners submits that the petitioners are merely a labourers, who have taken a lift on the said pick-up van while coming back from work and they have nothing to do with the electric wire.

No.58650 of 2017 (2) dt.12-12-2017 2/2 Considering the aforesaid facts and circumstances of the case and that the petitioners have got no criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., -II, Kishanganj in connection with Pothia P.S. Case No. 140 of 2017 corresponding to G.R. No. 1255 of 2017.
