JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Sahiyara P.S. Case no. 94 of 2017, registered under Sections 304(B)/34 of the Indian Penal Code.

The accusation is that the before 10 years, the marriage of Manju Devi, sister of the informant, was performed with Raj Narayan Mahto. After the marriage his sister was kept properly in her matrimonial house, but after sometime, she was being tortured for nonfulfillment of demand of dowry and lastly he was informed about admitting in hospital due to sustaining burn injury, when informant reached there then found dead body of his sister due to burn injury. He enquired about the death of his sister, but no proper reply was given to

Patna High Court Cr.Misc. No.55308 of 2017 (2) dt.27-11-2017 2/2 him by the in-laws of the deceased regarding sustaining of burn injury. Learned counsel for the petitioners submits that petitioners are mother-in-law and sister-in-law of the deceased, sister of the informant, and they have falsely been implicated in this case. Further submission is that, in fact, sister of the informant died after 10 years of marriage due to sustaining burn injury in course of making meal and she was rushed to the S.K.M.C.H. Muzaffarpur, but she died during the course of treatment. Further submission is that Raj Narayan Mahto, husband of the deceased, is in custody.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Sahiyara P.S. Case No. 94 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
