Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Submission is that there is no eye witness of the occurrence of killing and similarly situated co-accused Saryu Manjhi @ Sarju Manhi has already been allowed bail in Cr.Misc.No. 30979 of 2002 by order dated 03.01.2003. Petitioner is in custody since 29.03.2017.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned

Patna High Court Cr.Misc. No.60814 of 2017 (5) dt.30-03-2018 Court below where the case is pending in connection with Barachatti (Mohanpur) Police Station Case No.23 of 1999, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
