The petitioner seeks bail in a case registered for the offence punishable under 25 (1-b)a/26/35 of the Arms Act. One country made pistol is said to have been recovered from the possession of the petitioner and petitioner was apprehended in inebriated condition.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the seized article. He has been falsely implicated in this case by the police merely because some troll against ex-DGP, Bihar was

There is no use of pistol without cartridge. He had not consumed liquor. He happens to be a teetotaler. Though one more criminal case has been lodged against the petitioner but he is on bail in the said case. He has been languishing in custody since 14.02.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Jakkanpur P.S. Case No.81 of 2018.
