It is an admitted position that petitioner joined the University in August, 2002 and retired on 31.07.2005. He had opted for C.P.F. scheme specifically in the University and much after superannuation in the year 2016, now he wants a direction upon the University to pay him pension.

Not only the fact that he was a subscriber to the C.P.F. scheme and not an optee for pension scheme will come in his way, but also the fact that the number of years spent by him in this University in no way adds up to the minimum qualifying

Patna High Court CWJC No.10593 of 2016(3) dt.16-11-2017 2/2 period of pension.

The writ application is speculative writ application not based on any rule, law or precedent.

Writ is dismissed.
