The petitioners seek bail in Palasi P.S. Case No.207 of 2017 registered under Sections 379 & 411 of the Indian Penal Code.
As per the prosecution case, petitioners are said to have been apprehended while stealing away the she-buffalo of the informant.
It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their conscious physical possession. As a matter of fact, there was an altercation between the informant and the petitioners with regard to grazing of the cattle and due to this, the informant caught hold
Patna High Court Cr.Misc. No.53981 of 2017 (02) dt.13-11-2017 2/ 2 the petitioners and produced before the police after seven hours setting up a false and frivolous case against them. The production-cum-seizure list does not bear the signature of the petitioners. There is no criminal antecedent against the petitioners. Petitioners have been languishing in custody since 05.08.2017. Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 3rd, Araria in connection with Palasi P.S. Case No.207 of 2017.
