The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 448, 504, 506 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and it is submitted that an agreement for sale was entered between complainant and one Shila Sinha and petitioner from the side of Shila Sinha was instrumental in getting the agreement for sale executed, it is next submitted that some differences cropped up between Shila Sinha and complainant on account of which the agreement for

No.20664 of 2023(2) dt.24-06-2023 2/3 sale was not acted upon, accordingly Shila Sinha sent a legal notice to the complainant that the agreement for sale cannot be acted upon and she is willing to return the amount which was given to her in lieu of the agreement for sale with respect to the land, it is next submitted that Shila Sinha even sent two cheques for returning the amount to the complainant but the complainant chose not to get the cheques encashed and filed the present false complaint case, it is next submitted that thereafter Shila Sinha was granted provisional anticipatory bail by order dated 31.08.2018 in Cr. Misc. 34322 of 2018 on the condition that she will repay the amount to the complainant, learned counsel submits that provisional anticipatory bail of Shila Sinha stands confirmed as the money was returned to the complainant and the petitioner being mediator came to be implicated. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount
