JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 20-02-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Bettiah Town P.S. Case No.507 of 1998 under section 394 of the Indian Penal Code.
The allegation is that the miscreants snatched away the bag of the informant containing Rs.5300/- while he was going to his house.
The petitioner submits that he is not named in the F.I.R. and a final report has been submitted showing suspicion against him. However, differing with the police report, the learned Magistrate has taken cognizance.
Considering the facts and circumstances of the case, the petitioner Mahfuj Alam @ Munna is directed to be released on
Patna High Court Cr.Misc. No.35785 of 2014 (2) dt.20-02-2015 anticipatory bail, in the event of his arrest/surrender, in connection with Bettiah Town P.S. Case No.507 of 1998, on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah subject to the conditions that he would not physically absent himself for two consecutive dates till two witnesses are examined in trial.
