JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 506 of the Indian Penal Code.
The prosecution case is that the son of the informant Uma Shankar Gupta went to Mumbai through the employment agency of the petitioner. When he reached there, he was offered a job at Reyad in Saudi Arabia in lieu thereof an amount of Rs. 1,60,000/- was taken but at Reyad the son of the informant was under employed. Subsequently the son of the informant returned to India.
It is submitted by learned counsel for the petitioner that son of the informant has already returned and a statement to that effect has been made in para 12 of the petition. It is further submitted that there is no proof with
Patna High Court Cr.Misc. No.25210 of 2016 (2) dt.21-06-2016 2/2 regard to the payment.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 32 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
