Mr Ramadhar Singh, GP XXV ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 03-09-2019 Heard learned counsel for the petitioner and the respondent-State.

Petitioner was working as Block Welfare Officer. He has approached this Court for a direction for payment of salary for the period 26.07.2003 to 31.01.2006. The claim has been dealt with by the District Magistrate in the order dated 13.12.2012. After due consideration of all aspects of the matter including the fact that the petitioner, in order to evade arrest upon his implication in Dhoraiya Police Station Case No 25 of 2003, could not attend to his duties for some time. Other aspect

Patna High Court CWJC No.14752 of 2014(2) dt.03-09-2019 2/2 of the matter is that the order denying the petitioner's claim for salary is merely on account of his absence.

Whether the petitioner had any leave, which could be granted for the said period and to what extent, the services of the petitioner can be regularized by granting what nature of leave, is an issue which the petitioner's counsel proposes to raise before respondent No 6 in respect of the period in question.

With liberty, as aforesaid, writ petition is disposed of. (Madhuresh Prasad, J) M.E.H./- U
