JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Chiraiya P.S. Case No. 67 of 2015 registered for the offence under Sections-406 and 409 of the Indian Penal Code. Petitioner happens to be rice miller and he had to supply 6239.84 quintals of rice to corporation but he supplied only 2706 quintals of rice and hence, embezzled government money to the tune of Rs. 76,65,744.45/- Learned counsel for the petitioner drew my attention towards Annexure-4 to this petition and submitted that
Patna High Court Cr.Misc. No.28594 of 2015 (2) dt.27-07-2015 2/2 certificate case has been instituted and in the aforesaid certificate case, petitioner was directed to deposit Rs. 10,000,00/- (ten lacs) and in compliance of the aforesaid order, petitioner has already deposited Rs. 10,000,00/- (ten lacs) with the corporation. Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chiraiya P.S. Case No. 67 of 2015 to the satisfaction of Sri Uma Shankar, Judicial Magistrate-Ist Class, Sikarahana at Motihari subject to conditions as laid down u/S 438(2) of the Cr. P.C.
