The petitioner is in custody since 05.06.2018 in connection with Madhepura (Bharrahi) P.S. Case No. 133 of 2018 for the offence registered under Sections 341, 323, 324, 307, 354A, 379, 504, 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though it has been alleged that the petitioner gave spade blow on the head of the informant's son, the injury which has been found is said to be simple in nature. It is further submitted that there is land dispute between the parties and there was no pre-meditation and the occurrence took place on account of the sudden infuriation and fight between the parties.

No.45102 of 2018 (2) dt.10-08-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistarte, Madhepura in connection with Madhepura (Bharrahi) P.S. Case No. 133 of 2018.
