2. The petitioner seeks regular bail in connection with Gaurichak P.S. Case No. 49 of 2024 lodged on 29.01.2024, for the offence punishable under Sections 307, 302 & 34 of the Indian Penal Code read with section 27 of the Arms Act, pending in the Court of A.C.J.M.-II, Patna City.

3. As per the prosecution, FIR has been lodged against 8 named accused persons including the present petitioner. The specific allegation in the FIR against the petitioner is that he and one another accused person namely, Sonu Kumar have fired gun shot at the chest of the informant's brother, due to which he died on the spot.

4. Learned counsel for the petitioner submits that

Counsel submits that the petitioner is a victim in this case and has falsely been implicated. Counsel further submits that the petitioner is in custody since 14.08.2024, having no criminal antecedent.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. Learned counsel appearing for the informant vehemently opposes the prayer for bail of the petitioner and submits that there is specific allegation against the petitioner and one another accused person that they have fired gun shot at the chest of the informant's brother, due to which he died on the spot.

7. In the present facts and circumstances of this case considering that there is specific allegation against the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
