JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 394 of the IPC.

Petitioner is not named in the first information report and from perusal of the impugned order, it would appear that the name of this petitioner came in this case in the statement of spy of police and subsequently, confessional statement of the petitioner was recorded. Learned counsel appearing for the petitioner submits that police remanded the petitioner in several cases which had been lodged against unknown persons and, as a matter of fact, when the petitioner got bail in Basantpur P.S.

Patna High Court Cr.Misc. No.43730 of 2018 (2) dt.23-07-2018 case no.47/2018, police remanded the petitioner in the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, taking note of this fact that the petitioner is in jail custody since 21.2.2018 and up till now, police did not take any pain to put the petitioner on test identification parade, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate XI, Siwan in Daraundha P.S. Case no. 231/2017.
