The petitioner apprehends his arrest in Harshidhi P.S. Case No. 68 of 2013, registered for the offences punishable under Sections 379, 411, 414, 34 of the Indian Penal Code. The informant raided the premises of work-shop of Bittu Kumar and found that transformer repairing work was going on and he was illegally committed theft of the electricity caused loss of Rs. 3,35,790/- of the Company.
It is submitted that the petitioner is not named in the FIR. Name of the petitioner figured in the confessional statement of Bittu Kumar Singh, as he is Project Manager of Jenus Power Infrastructure Ltd., but no material is collected that the petitioner also committed theft of the electric energy.
Patna High Court Cr.Misc. No.36888 of 2015 (3) dt.04-11-2015 2/2 Learned Additional P.P. as well as learned counsel for North Bihar Power Distribution Ltd. did not point out any material against the petitioner.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harshidhi P.S. Case No. 68 of 2013, subje ct to the conditions as laid down under Section 438(2) of the Cr.P.C.
