The petitioner seeks regular bail in connection with Khagaria P.S. Case No.562 of 2017 instituted for the offences under Sections 272, 273 of the Indian Penal Code and 30(a), 36, 38, 41 of the Bihar Prohibition and Excise Act, 2016. The allegation in the present case is regarding recovery of 142 bottles of foreign liquor from the possession of the accused Sikandar Mahto and the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he is in custody since 20.08.2017 and has got a clean antecedent. Considering the nature of accusation, the period of
