The petitioner apprehends his arrest in Jamalpur P.S. Case No.04 of 2020, registered under Sections 341, 323, 308 and 34 of the Indian Penal Code.

The informant alleged that while she was sitting in her house, the petitioner and his wife assaulted her with iron rod and stone. The informant got serious injuries and she became unconscious.

Learned counsel for the petitioner submits that there is omnibus allegation of assault against the petitioner and his wife. Two injuries were found on the head of the informant. Both the injuries are simple in nature. The wife of the petitioner has already been granted regular bail by the court below on the date

Patna High Court CR. MISC. No.15242 of 2020(3) dt.06-10-2020 2/2 she surrenders. The case of the petitioner stands on the same footing.

Considering the facts that the wife of the petitioner has already been granted regular bail and the injuries found on the person of the informant are found to be simple in nature, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Munger in connection with Jamalpur P.S. Case No.04 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
