2. The petitioner is apprehending arrest in connection with Karjain P.S. Case No.82 of 2025 lodged on 15.07.2025, for the offences punishable under Sections 191(2), 191(3), 190, 115(2), 75, 329(3), 109, 303(2), 352, 351(2) and 351(3) of the B.N.S., 2023.

As per the prosecution, FIR has been lodged against 8 named accused persons including the present petitioner with allegation that they entered into the house of the informant and assaulted the informant and his family members. They tried to outrage the modesty of the female member of the informant and also assaulted his daughter. There is also allegation of snatching jewellary.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the petitioner and informant, both are resident of same village and they are well-known to each other. He submits that for the same date and place of occurrence, there is case and counter-case lodged from both the sides. The informant has lodged case i.e., Karjain P.S. Case No.82 of 2025 (present case) and the petitioner has lodged case i.e., Karjain P.S. Case No.83 of 2025. He further submits that none of the parties are criminal, but it is true that scuffling took place from both sides due to which injury has also been caused to both sides.

5. Counsel submits that the criminal antecedent of the petitioner is not clean as there are two criminal cases pending against him in which he is on bail. He further submits that on the previous occasion, injury report has been called for.

6. Learned counsel for the informant vehemently opposes the prayer for bail and submits that injury report may be called for as there is allegation against the petitioner that he has assaulted. He also submits that there is case and countercase between the parties.

7. Learned APP for the State opposes the prayer for bail of the petitioner, but fairly submits that there is case and

3/4 counter-case between the parties and injury has been caused to both sides.

8. Upon perusal of the case diary and the injury report, it transpires that the person who sustained injury, has attached a scan copy of the same by which it transpires that the injury report has been kept pending for report of CT scan.

As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of JMFC, Birpur, Supaul in connection with Karjain P.S. Case No.82 of 2025, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023 with other following conditions: (i) one of the bailor should be the family member of the petitioner who shall provide official document to show his bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bonds by the Trial Court itself;
