The petitioner seeks bail in connection with Sessions Trial No. 514 of 2019, arising out of Jamhor P.S. Case No. 35 of 2019 dated 01.04.2019 instituted for the offences under Sections 147, 148, 149, 341, 323, 325, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner and another had preferred an application for bail before this Court vide Cr. Misc. No. 50727 of 2019 which was rejected by order dated 20.11.2019. Thereafter, one of the petitioners of that case viz. Mantu Yadav again approached this Court vide Cr. Misc. No. 33372 of 2020. He was granted bail by

Patna High Court CR. MISC. No.27092 of 2021(3) dt.17-11-2021 2/2 this Court vide order dated 17.02.2021 by taking into account his period of custody and little likelihood of the trial being concluded in near future.

The petitioner also is in custody since 03.05.2019.

The report from the court below indicates that only charges have been framed as yet and the case has not proceeded any further.

Regard being had to the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XII, Aurangabad in connection with Sessions Trial No. 514 of 2019, arising out of Jamhor P.S. Case No. 35 of 2019 with the direction to him to participate in the trial. In case of the absence of the petitioner from the trial proceedings without the leave of the trial court in advance, the bail granted to him shall be liable to be cancelled.

The application stands allowed.
