JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 20-02-2015 All the three petitioners apprehend their arrest in connection with S.C./S.T. Act, P.S. Case No. 40/2014, dated 29.05.2014, instituted for offences under sections 341, 342, 323, 504, 506, 452, 292, 354/34 of the Indian Penal Code and section 3(1)(x)(xiv) of S.C./S.T. Act.

It is, inter-alia, alleged that when the informant and another were returning from a cattle fair, they were first beaten up. Then when the informant came to her house and was narrating the incident to her handicapped husband, the three petitioners came there and they all beaten up the informant and her husband, dragged them from their house and tied their hands and feet.

Patna High Court Cr.Misc. No.35264 of 2014 (2) dt.20-022/2 Learned counsel for the petitioners draws attention of the Court to Annexure 2 showing land dispute between the two parties i.e. petitioner no.3 and son of the informant. It is submitted that this is nothing but a false case to implicate the petitioners. In that view of the matter, in the event of arrest or surrender within a period of four weeks from today, all the three petitioners, namely, (1) Awadhesh Thakur @ Madesh Thakur @ Awadesh Takur @ Madesh Takur, (2) Ram Vinay Thakur @ Ramvinay Takur and (3) Kriti Thakur @ Ramkrite Thakur @ Kriti Takur @ Ram Karite Takur are directed to be admitted to bail on executing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa (Nalanda), in connection with S.C./S.T. Act, P. S. Case No. 40/2004 dated 29.05.2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
