JUSTICE RAKESH KUMAR ORAL ORDER 25-07-2016 Heard Sri Rajeev Ranjan No. II, learned counsel for the petitioner , learned Additional Public Prosecutor as well as learned counsel, who has appeared on behalf of the opposite party no. 2 /State Bank of India.

The sole petitioner, apprehends his arrest in connection with Chhauradano P.S. Case No. 195 of 2015 registered for the offence under section 467, 468, 471, 419, 420 of the Indian Penal Code, has prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioner that the alleged cheque amount though earlier was withdrawn and same amount was transferred to the savings bank account of the petitioner immediately thereafter the petitioner has already

Patna High Court Cr.Misc. No.26683 of 2016 (3) dt.25-07-2016 2/2 refunded the entire amount to the bank and on this very ground a prayer was made for grant of anticipatory bail, whereas on perusal of the F.I.R. it is evident that on the basis of forged cheque huge amount to the tune of rupees Forty Lakhs was initially got transferred to the account of the petitioner which was presented by the petitioner himself.

I do not find any ground to extend the privilege of anticipatory bail.

The petition stands dismissed.
